Terms & Conditions

These Terms and Conditions govern your use of the services provided by Modern Driving za (Pty) Ltd ("Modern Driving School", "we", "us", "our"). By booking or taking a lesson with us, you agree to these terms.
1. Bookings
Lessons are booked by WhatsApp, phone, email, or our website booking form and are subject to availability. A booking is confirmed once we have acknowledged it and, where applicable, received payment.
2. Payments
Payment is made by EFT to Modern Driving School before your lessons, using your name as reference. All payments made to Modern Driving School are final and non-refundable. Package hours remain valid subject to any period we communicate to you at the time of booking.
3. Vehicle hire and test day
Where a package includes vehicle hire, hire costs are subject to change depending on the traffic department. Free vehicle hire is included on 30-hour packages. Car Hire for Test Day packages include a warm-up lesson before your test.
4. Scope of lessons
Driving lessons are strictly for driver instruction and road-safety training. They are not a general transport service to destinations, and may not be used as such.
5. Pickup and coverage areas
We offer free Code 8 pickup and drop-off within our designated coverage areas. In the South Peninsula, Code 8 lessons run as 2-hour sessions. Code 10 lessons use designated pickup points rather than door-to-door pickup, unless a session of 2 hours or more is booked. Coverage outside our listed areas is at our discretion.
6. Vehicles
Lessons are conducted in our insured, dual-control vehicles as standard. You may request to use your own vehicle, but it must be roadworthy and appropriately licensed and insured, and this remains subject to our approval. We recommend school vehicles for safety and consistency.
7. Your responsibilities
You must hold a valid learner's licence to take practical driving lessons, arrive on time and ready for your lesson, and treat the instructor and vehicle with reasonable care. You are responsible for booking your own learner's and driving tests with the traffic department and for the related booking fees and required documents.
8. Cancellations and rescheduling
If you need to cancel or reschedule a lesson, please contact us as early as possible so we can offer the slot to another learner. We may cancel or reschedule a lesson due to weather, vehicle, or operational reasons, in which case we will arrange an alternative time.
9. Conduct and safety
For everyone's safety, the instructor may pause or end a lesson if a learner is under the influence of alcohol or drugs, behaves unsafely, or does not hold the required valid learner's licence. Lessons ended for these reasons are not refundable.
10. Liability
To the extent permitted by the Consumer Protection Act, 2008 and other applicable South African law, our liability arising from our services is limited to the fees you have paid for the affected service. Nothing in these terms excludes any liability that cannot lawfully be excluded.
11. Website
The content, branding, and materials on our website are owned by Modern Driving za (Pty) Ltd and may not be copied or used without permission. We are not responsible for the content of third-party websites linked from ours.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts. We ask that you contact us first so we can try to resolve any issue directly.
13. Changes
We may update these terms from time to time. The latest version will always be available on our website.
